    Der oberste Gerichtshof hat mit Mehrheit die rechte von Schwulen und Lesben verbessert und Trumps Widerspruch gegen ein kalifornisches Gesetz zum Schutz von Migranten abgelehnt.
    Kann mir das jemand erklären, nachdem ich hier des Öfteren gelesen habe, daß der Oberste Gerichtshof für lange Zeit eindeutig eine rechtskonservative Mehrheit hat.

    Ich kann es versuchen, obwohl ich natürlich kein Jurist bin. Der von Trump nominierte Richter Gorsuch hat die Urteilsbegründung geschrieben - wenn man Vox glauben darf, liess seine juristische Philosophie auch keine andere Entscheidung zu:

    Gorsuch is a vocal proponent of “textualism,” the belief that the meaning of a law turns on its words alone, not on the intentions of the law’s drafters. And Bostock [die Bezeichnung für den konkreten Fall] forced Gorsuch to decide between his own conservative politics and following the broad language of a landmark civil rights law. [...]

    At the very least, Bostock suggests that this conservative Supreme Court can follow the clear text of a law, even when that reading points in a liberal direction.

    Gorsuch selbst beründet, warum das Verbot der Ungleichbehandlung der Geschlechter eben auch die Ungleichbehandlung von Homosexuellen oder Transgender-Personen verbiete:

    Consider, for example, an employer with two employees, both of whom are attracted to men. The two individuals are, to the employer’s mind, materially identical in all respects, except that one is a man and the other a woman. If the employer fires the male employee for no reason other than the fact he is attracted to men, the employer discriminates against him for traits or actions it tolerates in his female colleague. [...]

    Or take an employer who fires a transgender person who was identified as a male at birth but who now identifies as a female. If the employer retains an otherwise identical employee who was identified as female at birth, the employer intentionally penalizes a person identified as male at birth for traits or actions that it tolerates in an employee identified as female at birth. Again, the individual employee’s sex plays an unmistakable and impermissible role in the discharge decision.

    Gorsuchs Anspruch, immer möglichst exakt der Sprache des Gesetzes entsprechend zu urteilen, kommt Konservativen in vielen Fällen sehr gelegen (bei der Auslegung des zweiten Verfassungszusatzes etwa), hier allerdings nicht, wie man auch an den wütenden Reaktionen sieht.

    Es ist ja auch nicht so, dass der Supreme Court Entscheidungen IMMER im Stimmenverhältnis 5:4 und mit entsprechendem konservativem Urteil fällt (sonst gäbe es ObamaCare schon nicht mehr); er tut das aber sehr oft - vor allem dann, wenn es um Machtfragen oder die Rechte von Big Business geht.

    Es stecken ja auch noch ein paar sehr strittige Fälle in der Pipeline; Kevin Drum sieht denn auch eine andere Erklärung für das heutige Urteil zugunsten der LGBTQ-Community - nämlich eine PR-Aktion des vorsitzenden Richters, um die Unabhängigkeit des Gerichtshofs zu betonen, damit es nicht so auffällt, wenn man demnächst wieder auf konservativen Kurs geht:

    Because I can see a cloud behind every silver lining, I should mention that I have a theory about John Roberts: namely that he votes with the liberals occasionally on topics he considers unimportant so that he can join the conservatives on all the rest of the rulings. This allows him to keep his reputation as a fairminded umpire without sacrificing much.

    But that’s probably just cynical of me. I’m sure he doesn’t really do that.

    RCP ergänzt, dass die Angelegenheit vielleicht auch eine Generationenfrage sei - für jüngere Konservative sei der Kampf gegen Homosexualität schlicht abgehakt:

For Gen Xers, and especially millennials, even among conservatives there is growing acceptance of sexual minorities.     Die Begründung ist jedenfalls gut. Da kann man nichts dagegen sagen.

    Ganz allgemein ist es mE auch falsch, darauf zu vertrauen, daß ein Richter über die Jahre immer denselben Werten treu bleibt. Er kann auch in seine Rolle hineinwachsen und sich daran gewöhnen, daß ihm jetzt nie wieder jemand etwas dreinreden kann. Er braucht keine Sympathiepunkte von seinen ehemaligen Förderern mehr.

    Alle fünf konservativen Richter bezeichnen sich selbst als "textualists", faktisch steht nur einer zu dieser Richtung, wenn es auch gegen die eigene politische Haltung geht. Roberts stimmt nur dann mit den Liberalen, wenn es um für ihn unwichtige Themen geht, er nicht die entscheidende Stimme für die Liberalen ist und um damit einen "unabhängigen" SC vorzugaukeln. Samuel Alito hat in seiner Gegenmeinung quasi das exakte Gegenteil von textualism demonstriert, für den er angeblich steht. Ich sehe in der Entscheidung zwei Möglichkeiten:

    a) sehr wahrscheinlich: Es kommen bald Entscheidungen, die DACA für ungültig erklären, politisches gerrymandering für gültig und diverse andere Entscheidungen pro Trump und GOP. Bei Protesten wird man auf die Entscheidung für die Gleichberechtigung der Geschlechter verweisen.

    b) man glaubt, dass Trump verliert und der Senat demokratisch wird und fürchtet ein "packing" des SC, auch wenn Biden das ausgeschlossen hat. Es geht insbesondere Roberts darum, Biden bzw. progressiven Dems keine Munition dafür zu liefern. Eine völlige Abschaffung von Abtreibungen wäre so ein Punkt, bei dem Biden seine Meinung ändern könnte/ müsste.

    c) auch ohne eine Erweiterung des SC besteht die Möglichkeit, dass der SC "liberal" wird. Wenn Trump krachend verliert und die Senatsmehrheit flöten geht, könnten die Dems für 8 Jahre die Präsidentschaft und für 4- 8 Jahre die Mehrheit im Senat stellen (2022 hat die GOP eine sehr ungünstige Ausgangslage im Senat). Schon jetzt bereitet man vor, dass Washington DC ein Staat wird, heißt zwei demokratische Senatoren/innen mehr.

    Die ältesten Richter sind: Ginsburg (87 Jahre, Dem), Breyer (81, Dem), Thomas (71, GOP) und Alito (70, GOP). Die ersten zwei werden mit Sicherheit unter einer Präsidentschaft Bidens durch liberale RichterInnen zwischen 50 und 60 Jahren ersetzt. Das bringt keine Mehrheit, aber vier relativ junge liberale RichterInnen. Bei Thomas und Alito wird man sehen, wie sie physisch fit bleiben. Thomas sagt man öfters eine gewisse Lustlosigkeit nach, er ist mit 28 Jahren SC-Richter der Dienstälteste und sorgt immer mal wieder für helle Aufregung, wenn er bei Anhörungen eine Frage stellt, weil das bei ihm absoluten Seltenheitswert hat. Ob es so clever war von Graham, ihm zum schnellen Rückzug unter Trump zu drängen?

    Ja, wirklich keine gute Woche für die Drumpf-Agenda - die 700.000 vom DACA-Programm vor Abschiebung geschützten Nachkommen illegaler Immigranten dürfen zunächst bleiben.

    DACA ist jetzt aber nicht für alle Zeiten sicher - der Gerichtshof urteilte lediglich, dass Trumps Begründung für die Beendigung des Programms fehlerhaft gewesen sei.

    Obviously this is good news for Dreamers, but the part that really tickles me is that the ruling doesn’t actually say that DACA can’t be repealed. It just says that Trump was so incompetent that he failed to follow the rules for repealing it. This has always been the silver lining behind the Trump cloud: namely that he’s such an idiot that he’s caused a lot less damage than, say, a Ted Cruz or a Marco Rubio, who would know how to get things done legally and properly so they could withstand judicial review.

    At least, that was the silver lining prior to the coronavirus outbreak, where Trump’s idiocy is just straight up killing people.

    Aber es ist deutlich sicherer geworden. Bis November wird es Trump nicht schaffen, eine juristisch tragfähige Nachfolgeregelung zu finden. Und der Zeitablauf verfestigt den Aufenthaltsstatus.

    Ich glaube, damit wird einfach ausgedrückt, dass der Mann den POTUS möglichst schnell besiegt sehen will. Ob die Urteile Trump wirklich schaden? Demotivierend könnten sie sein für die Basis, klar, andererseits haben Immigrationshardliner oder sozialkonservative Christen halt auch nicht wirklich ne Alternative. Letztlich könnte es sogar motivierend sein, wenn man ihnen sagt, man brauche halt unbedingt noch ein oder zwei weitere konservative Richter, um bei Urteilen wirklich auf der sicheren Seite zu sein.

    Ich würde fast meinen, dass die Urteile für die betroffenen Minderheiten natürlich ein Segen sind, aber das Wahlergebnis nicht groß beeinflussen werden - wissen kann man es aber nicht.

    Roberts hat die Entscheidung wohl für unbedeutend gehalten. Trump wollte DACA als Faustpfand für Verhandlungen mit den Dems nutzen, um seine Mauer zu bekommen. Hätte er seinen Willen bekommen und die Dems gemauert, wäre es wohl zu chaotischen Zuständen - politisch und sozial - gekommen. Ich denke, die meisten GOP-Senatoren sind insgeheim heilfroh, dass das Problem erst mal vertagt ist.

    Wer das Urteil liest merkt auch, dass die Trump-Organisation unglaublich faul und juristisch unbeholfen war bei ihrer "Kündigung" von DACA. Sie haben einfach gesagt, Obamas Entscheidung war gesetzeswidrig und nicht begründet, warum man sie von einem Tag auf den anderen aufheben möchte und wie das dann für die Deamer laufen soll.
